EXTENSION UNTIL 31.7 OF NON-PAYMENT OF RENT AND DECLARATION OF PROFESSIONAL LEASES!

The new law 4818/2021 was published in the Official Gazette, which among other things extends the possibility of exemption from the payment of July rent for certain specific professional activities that are still affected by the measures for the corona virus, which will be determined by the July 2021 KYA of the KAD.

Also with the same by law, the deadline for tenants to file for extensions of government-mandated business leases, as long as the tenants are in arrears, isextended to July 31, 2021.

AMENDMENT FOR A FULL MONTH EXTENSION OF THE “MECHANIC’S CERTIFICATE”!

The waste bill included the amendment extending until 30.9.2021 the validity of the engineer’s certificates, whose autopsy had been carried out until 31/01/2021, the which was already submitted for processing to the competent parliamentary committee on Thursday, July 15, 2021.

Specifically in Chapter VII of s.n. “para. 5 of the eighteenth article of n. 4787/2021 (A’ 44) is amended in terms of the period of validity of the certificates of par. 1 of article 83 of n. 4495/2017 (A’ 167) and is formulated as follows: “5. The period of validity of the certificates of par. 1 of article 83 of n. 4495/2017 (A` 167) with an autopsy date from 1.1.2021 to 31.1.2021 is extended until 30.9.2021, with the possibility of being subject to regulation after 1 February 2021, without the obligation to register building/divided property identification information.” .

THE TAX BURDEN FROM PROPERTY OWNERSHIP IS BIG FOR CLOSED AND INJURED INDIVIDUAL BUSINESSES!

Victims who needed assistance due to the corona virus were not only the tenants of properties, but also the owners of closed and affected businesses, housed in privately owned properties, for which unfortunately no tax relief was applied relief, which is why the leadership of the Ministry of Finance must look carefully at this issue and provide a solution even at the last moment, so that thousands of individual businesses are not burdened with large amounts of tax due to the private use of their properties. 

This was pointed out two months ago by the well-known accountant – tax expert Mr. Konstantinos Dim. Gravias, in his article on the authoritative portal www.taxheaven.gr, on which a question in the House of Representatives was based of SYRIZA, to which the AADE responded, declaring substantial incompetence.

UNTIL 20.7 THE DECLARATION OF TERMINATION OF OLD LEASES WITHOUT FINE. DECISION ON COVID FIXES PUBLISHED!

With the decision A.1158/2021 of the Governor of AADE Mr. Giorgos Pitsilis, significant amendments are made to the basic POL.1162/2018 which regulates the issues of COVID compensations, and is satisfied series of requests by POMIDA, which were included in its letter dated 23.6.2021 to the Ministry of Finance and the AADE.

Among them, paragraph 2 of article 9 of the under POL.1162/2018 decision of the Governor of A.A.D.E. (B’ 3579) was replaced as follows:

AADE: NEW CLARIFICATIONS FOR MARCH 2020 TO MAY 2021 COVID DECLARATION!

Due to questions that have arisen after the submission of the “Covid Declarations”, the new circular 2139/2021 of the AADE clarifies the following:

  1. In the event that a declaration of termination of the lease has been submitted for a property that is used beyond the contractual term of the lease (non-contractual use) and use compensation is paid, in order for the application of the favorable regulations of par. 2 of article 13 of Law 4690/2020, for this reason alone, a “Property Lease Information Statement” should be submitted, in the “Type of lease” field select ” Non-contractual use”and the amount of the use compensation should be entered in the “Total monthly rent” field. The lessor in this case is asked to provide supporting documents that prove the actual fact such as indicatively the lease that expired (depending on the time period of the start of the lease, electronic or handwritten) and the E2 of the previous years in which the amount of compensation or rent was declared which was paid.

AT A PUBLIC CONSULTATION, S.N. FOR ESTATE AND THE NEW DIGITAL SERVICES!

The Minister of State, Mr.Kyriakos Pierrakakisput the draft law of the Ministry of Digital Governance entitled:“Modernization of the Greek Land Registry, new digital services and strengthening of digital governance”.

This draft law attempts to:
a) the acceleration of the completion of the real estate registration processand the transition to the status of a functioning Land Registry, the streamlining of the procedures for correcting the first inaccurate cadastral records and the modernization of the operation of the n.p.d.d. “Hellenic Land Registry” (Part A’),
b)the creation of new digital public services provided to citizens and businesses through the Unified Digital Portal of the Public Administration (Part B΄), and
c) the strengthening of digital governance through the regulation of issues of organization and operation of the Ministry of Digital Governance, its supervised entities and the National Telecommunications and Posts Commission (ETT .) (Part C’).

AADE: IN A LINE OF E2 THE RENTS OF 2020!

Another request of POMIDA became a reality: With an as yet unpublished circular (E.2136) signed by the Governor of AADE, Mr. Giorgos Pitsilis on 5.7.2021,

Specifically in this circular it is stated that:“Especially for this year, only the total gross amount of the income from the rental, subletting, free concession and personal use of the real estate may be completed per property and per tenant, without requiring the completion in column 11 (11) of the monthly rent/subrent or an assumed amount corresponding to the private use or free grant of the real estate. … It is clarified that it is not required to submit amending statements for those already submitted.”

POMIDA: CREATION OF A DIGITAL PLATFORM FOR STUDENT HOUSING IN PRIVATE RESIDENCES!

Each summer for the past several decades, we witness (and sometimes fall victim to) an annual recurring scenario, that of college freshmen and their families, anxiously seeking housing in another and usually unknown city, immediately after the announcement of the university entrance exam results, through tenements stuck outside and around them. The existing student residences are known to be insufficient, which is why the burden of solving the student housing problem was borne by the private initiative. For this reason, POMIDA sent a letter to the competent Ministers with its proposals…

AADE: THE APPLICATION IS OPEN FOR DECLARATION AND CORRECTIONS COVID!

Responding to the continuous requests of POMIDA, AADE opens again its application (www.aade.gr) for submission of COVID declarations concerning the following cases of compensation of lessors for forced reductions rents:

* Until 15.7.2021: – For initial COVID declarations for the month of May 2021, for which the relevant compensations have already been paid . Beneficiaries of compensation collection for the month of May landlords/sublessors, are required to submit a COVID declaration regardless of whether they have not yet been paid the compensation. Those who were paid compensation without being entitled to it, should not make a statement.
