SUBJECT: REQUEST FOR EXTENSION OF DEADLINES FOR DECLARATION OF VOLUNTEERS & OF REAL ESTATE

Dear Minister

The unprecedented situation in which society and our country found itself during the last quarter, due to the coronavirus epidemic, which to some extent continues to affect citizens and their activities, necessitates the extension of statutory deadlines for various vital matters concerning property owners in your jurisdiction, with the bill you are about to table in Parliament, as follows.

A . DISCLAIMER. We request that the deadline for the legalization of any kind of arbitrary beextended for one semester, i.e. until 31.12.2020. The extension is absolutely necessary, given the economic conditions that prevailed during the last quarter in the country and the inability of citizens and engineers to collect the required documents.

B. NATIONAL LAND REGISTRY.

  1. LAND REGISTRY PROCEDURE. We request not to activate any procedure for imposing fines on citizens who come to declare their properties until 31.12.2020, regardless of the time of expiry of the individual land registration deadlines.
  2. EXTENSION OF DEADLINE FOR CORRECTION OF INACCURATE FIRST DOCUMENTS.  Article 102 of Law 4623/2019 set 31.12.2020 as the deadline for correcting the initial entries in the National Land Registry, after which private individuals permanently lose all their undeclared ownership rights, while the State is entitled to claim of each property declared by a private individual for another two years!  This deadline was excessively shortened for some regions of the country, such as Heraklion, Crete. That is why we propose and requestthe annual extension until 31.12.2021of the deadline for correcting ALL inaccurate first entries in the Land Registry Offices of of the country.

These should also include the incomprehensiblely excluded from the general extension “unknown owner” properties in 35 Municipalities and regions of the country (Vrilissia, Elefsina, Astros, Kalamaria, Goumenissa, etc.), with already operating cadastral offices.

  1. SOLVING THE PROBLEM OF PUBLIC CLAIMS. The accumulation of more than 200,000 objections against cadastral postings, in addition to the approximately 100,000 pending cases in the civil courts, we believe has convinced you of the dire need for an immediate legislative solution to the ownership problem of off-plan real estate in the country, with regulation thatthe State cannot claim indefinitely and without any ownership title, property rights over them if private individuals have been spinning them in good faith for decades with legal titles and with similar conditions, to those set by article 4 of the law. 3127/2003 for the properties within the plan.

The continuous uncritical statement by many government agencies (forestry departments, regions, etc. .) in the process of land registration, huge private unplanned lands as supposedly state and the refusal to date to delimit the absurd and unconstitutional claims of the State, which continues to demand in the relevant trials ownership titles dating back to 1885 (!)constantly creates legal battles that will last for generations between hundreds of thousands of owners and the State, which, it should be noted, unethically litigates all the way to the Supreme Court, exterminating its opponents financially as well as in terms of age

All this hinders the rapid completion of the National Cadastre, violates the constitutional provisions on the protection of private immovable property and turns the Cadastre and forest maps into tools not for recording, but for confiscating the property of hundreds of thousands of honest people citizens all over the country!

That is why, Mr. Minister, we call on you to put an end to this suffering of hundreds of thousands of citizens, from all over the country, but also to this insurmountable obstacle for the completion of the Cadastre, solving the ownership problem of off-plan properties, assuring you that you will have rendered a huge service to our country and its society.

We ask you to invite us in a direct dialogue in order to develop these proposals in particular, which we invite you to include in the forthcoming draft law of your Ministry.
