LAW 4772/2021 WAS PUBLISHED WITH THE REGULATION FOR THE REDUCTION OF RENTS FOR JANUARY-FEBRUARY!

Law 4772/2021 was published, which includes the new regulation for the reduction of real estate rents for the months of January and February 2021, together with many other urgent fiscal and tax regulations and other provisions.  Then a new ministerial decision will be issued based on the new regulation for rents for the months of January and February 2021, which will determine:

* For which commercial leases of businesses closed by government order will be subject to the 100% rent reduction for those months, and

* For which commercial leases of affected people (which will be and most), but also for employees’ residences, the reduction will remain at 40%. Its most important tax provisions are the following:

HATZIDAKIS FROM THE POMIDA CONFERENCE: SUSPENSIONS OF EMPLOYMENT CONTRACTS ONLY WITH ADVANCE NOTICE !!!

The response of the Minister of Employment, Mr. Kostis Hatzidakis, to the complaint made by POMIDA at its 38th Congress about virtual work suspensions that are announced long after the period that they allegedly concern, with the aim of reducing residential rents, but also to collect the foreseen compensations from the State. In fact, in these cases, the right to abatement is announced to the lessor at a time when, as a rule, the deadline for submitting a COVID declaration has expired, as a result of which the right to collect the legal compensation is lost, while the tenant unilaterally and arbitrarily withholds the abatement from the next rents.

PRESS RELEASE OF THE 38TH ONLINE UNIVERSITY. CONFERENCE POMIDA, SATURDAY 30.1.2021!

IN THE PARLIAMENT THE REGULATION FOR THE REDUCTION OF RENTS FOR JANUARY-FEBRUARY!

The bill with emergency regulations to deal with the effects of the COVID-19 coronavirus pandemic, emergency fiscal and tax regulations and other provisions was submitted to Parliament. According to the new regulation for rents for the months of January and February 2021, a new ministerial decision will follow which will determine which business leases of businesses closed by state order will be subject to a 100% rent reduction for these months, and which business leases of victims, but also of workers’ housing will remain at 40%. Its most important tax provisions are the following:

ELECTRONIC IDENTITY: STARTING FROM 1.2, UNTIL 31.3 THE CERTIFICATES OF ENGINEERS FOR CONTRACTS!

From 1th February 2021 the Electronic Building/Detached Property Identity ceases its optional – pilot function and is in force as mandatory. However, according to a transitional provision in the relevant ministerial decision, the engineers’ certificates with the date of the autopsy up to 31.1.2021 can be used for the transfer of real estate until their expiration without the obligation to register Building/Apartment Identity information property.

YPEN: EXTENSION UNTIL APRIL 1ST FOR BUILDING IDENTITY!

POMIDA’s request to extend the start date of the full implementation of the electronic building identity is partially accepted. Both from the recent communication of the President of POMIDA with the political leadership of the Ministry of Foreign Affairs, as well as from the report of the authoritative portal Ecopress.gr it follows that the normal application of the Electronic Building Identity will start from April 1, 2021, instead of February 1, 2021 that was originally planned, after listening to the proposals of the bodies of engineers, notaries and POMIDA.

MINISTER: FOREST MAPS PROTECT CITIZENS’ PROPERTIES!

An announcement was issued by the Ministry of Foreign Affairs, after reports according to which property owners who either with the previous or with the current procedure lose the right to appeal against the new posting of forest maps posting, they did not express an interest in objecting or applying for reformation, for which areas the current status of partial sanction of their character is maintained. The Ministry is in a hurry to complete the process of final approval of the forest maps in order to end the whole pending situation, for many reasons, among which is the pending application to the Council of Ministers to cancel the ministerial decision Hatzidakis on the new posting, in favor of which he has intervened the POMIDA.

POMIDA TO FINANCE: REQUEST FOR IMMEDIATE CHANGES TO RENT REDUCTION ARRANGEMENTS!

In view of the fact that we have reached January 21st and real estate landlords are facing a completely unclear situation in relation to what applies in terms of January rent payments and the return process of legal compensations, in a letter to the political leadership of the Ministry of Finance, POMIDA requested immediate changes in the regulations for the reduction of rents, pointing out the most serious problems faced by real estate landlords and proposing immediate measures to solve them.
