Not yet issued and published the decision with No. residence 4374/131 in Official Gazette B’ 345/31.01.2021 under the title: “Suspension of employment contracts of employees in enterprises – private sector employers during month of February 2021”.
With the new regulation, the procedure for the advance submission of staff status change forms resumes from the month of February of businesses in the “ERGANI” Information System, for all cases.
Especially with regard to the suspensions of employment contracts, following the information from January 29 that they will continue and in February (according to the standards of the KAD list of closed and affected businesses of the relevant Joint Ministerial Decision of January), it is pointed out that the procedure for declaring suspensions on behalf of employers is modified and becomes pre-announcement, based on the experience of of recent months and with the aim of the most rational operation of the system. More specifically:
- The suspension of employees’ employment contractsis announced at least the day before the start of the suspension. But especially for the employment contracts that are suspended from the 1st to the 5th of February 2021, to facilitate the businesses, the responsible declarations of advance notice of the employers-enterprises are submitted within the first five days of this month.
- The advance notice can concern either independent time periods within February or the entire month .
- In any case, any change to the pre-announced suspension of the employees’ employment contracts is announced too, with the procedure of temporary revocation.
- The temporary revocation is also announced at least the day before the start of the change. is voidand does not produce the effects of the suspension of the employment contract, among which is thatthe employer continues to pay his employees, but also that the suspended employee is not entitled to a reduction in rent of his child’s main or student residence.
