YA FOR 30% REDUCTIONS, DEFAULTS AND ROUNDING ERROR COMPENSATIONS!

With the A1053/2021 decision of the Deputy Minister of Finance, Mr. Apostolos Vesyropoulos, which amended A.1193/24.08.2020, three more procedural issues regarding the payment of compensation to property owners due to reduction of rents.

  1. The possibility of compensating the owners not only for the forced reduction at least by forty percent is clarified ( 40%) of the rents due to the mandatory rent reduction measures, but also for the at least thirty percent (30%) optional rent reduction, following an agreement between the lessor and the lessee for the exemption from the payment of part of the total rent. This opens the possibility to clear and pay the compensations for the months of September and October 2020, but also to correct any errors in the relevant declarations, even when the platform is opened for these months as well, as POMIDA insists.

POMIDA TO FINANCE: 2020 RENT TAXATION DEFERMENT WITH EXCLUSION, ALSO FOR 40% DISCOUNT DUE TO UPGRADING WORKS & PAYMENT OF INHERITANCE TAX WITH PROPERTY TRANSFER!

After the receipt comes the tax nightmare for property owners who have received 2020 rents from their tenants but, when it comes to filing income tax returns, are completely unable to follow the applicable process postponement of taxation of uncollected rents, which requires functioning courts and open D.O.Y.  That is why it is necessary, especially for the uncollected rents of 2020, to immediately give the possibility of deferring their taxation only with the notification of the extrajudicial court provided for by article 637 of the Code of Civil Procedure. For the same reason, it is urgent to immediately issue the Decree on the deduction from income tax of 40% of the costs of building upgrade works, while the Ministerial Decision on the payment of inheritance tax with the transfer of property to the State has been unjustifiably pending for many years.

For these issues, POMIDA sent the following letter to the Minister of Finance Mr. Christos Staikouras and the competent Deputy Minister Mr. Apostolos Vesyropoulos.

RENT REDUCTIONS AND REFUNDS ON SUBLETTING PROPERTIES. ANALYSIS BY STRATO PARADIA & GIORGO CHRISTOPOULO!

In the initial phase of the recognition of compensatory compensation due to rent reduction, the legislator did not explicitly consider tenants/sublessees as beneficiaries of rent reduction, so that in turn their landlords not be beneficiaries of this compensation. This was retroactively changed with the provisions that we mention below, and today it is applied according to the detailed examples that we cite, from which it is clear who are beneficiaries or not, of the relevant reductions and compensations.

IMPLEMENTATION OF POMIDA REQUESTS HAS STARTED: NEW DEADLINES FOR SOLUTIONS, CORRECTIONS AND COVID STATEMENTS!

Along with the opening of the month of February 2021 in the implementation of the AADE, the decision A.1050/2021 of the Governor of the A.A.D.E. was published in the Official Gazette. Mr. Giorgou Pitsili which amends his decision under POL.1162/2018 entitled “Submission of Real Estate Lease Information Statement using an electronic method of communication via the internet » (B’ 3579).

With the new arrangements, which respond to relevant requests of POMIDA, and which so far lack the possibility to submit initial COVID declarations from March to October 2020, the following important changes were launched, as recorded by the tax technician Mr. Giorgos Christopoulos:

AP. VESYROPOULOS: RENT REDUCTION AND LANDLORD SUBSIDIES CONTINUE!

The financial support of the affected sectors of the economy continues for the month of March. The Deputy Minister of Finance Mr. Apostolos Vesyropoulos announced the following regarding the real estate leasing sector:

Following the measures analyzed by previous colleagues, I will refer in order in the reduction of rents and the suspension of regulated tax and insurance obligations.

As has already been announced, the regulation providing for the full exemption was extended for the month of March from the obligation to pay rent for businesses that remain closed by government order.

RENT REDUCTIONS: INITIAL COVID DECLARATION, DEADLINES AND SUBLEASES!

POMIDA sent a letter to the competent Deputy Minister of Finance, Mr. Apostolos Vesyropoulos, highlighting three points in the process of compensating property owners from rent reductions due to COVID, and asking for solutions. with requests:

*To accept not only corrective but also initial COVID declarations for all months of the year 2020, and for all those owners who missed the relevant deadlines ,

*Set at least a monthly deadline from informing owners of errors and reasons for rejection of COVID declarations, and

*To clarify whether rent reductions imposed by sublessors on property owners are legal when the rental properties are used by third-party sublessors.

THE FEEDBACK FOR THE COVID RENT REDUCTION COMPENSATION PROCESS!

POMIDA immediately at the start of the health crisis predicted that government intervention would be inevitable in favor of businesses and households – renters who would be affected by its countermeasures, which with in turn, they would turn the lessors of these properties into serious victims. That is why with her continuous interventions and her unceasing effort, she requested and managed to secure from the government compensations that have gradually increased since last March and currently reach up to 80% of the rent, and already the reopening of the platform for declarations of reductions of 2020.

The Ministry of Finance issued the following Press Release:

The Government, from the beginning of the health crisis, planned and implemented a series of measures to deal with the economic effects of the pandemic and to share – in terms of social justice – the burden caused to households and businesses. Among these measures, rent reduction for affected businesses and households is included. The extension of measures against the pandemic, which has as a consequence the difficulty or complete inability of citizens and technicians to access all relevant public services (urban planning, mortgage offices, cadastral offices, municipalities, etc.), combined with the exclusive validity of the building identity from 1.4.2021, turns real estate transfers into a nightmare and urgently raises the issue of reviewing the entry into force of this measure.
