PROFESSIONAL LEASES: IN PARLIAMENT THE PROVISION OF EXTENSION FOR “CLOSED” BUSINESSES!

Article 111 of N. 4790/2021 which was voted in the Parliament and already published, included, among other interesting provisions, the possibility of a few-month extension of the leases of commercial properties whose businesses that use them remained “closed by state order” during the pandemic, and for a period of time equal to their mandatory shutdown.

The tenants have the right to an extension or sublessors declare it in writing to the owners within one month of the entry into force of the law, and on the condition that at the time of the declaration they will be completely consistent with their obligations, i.e. they will not owe rents. Therefore, those who owe rent should pay off their debts before submitting their written statement.  As long as the above conditions are met, the declaration is mandatory for the owner and increases the duration of the lease accordingly.

STAIKOURAS TO POMIDA: TWO MONTH COMPENSATION WITHOUT MARCH COVID DECLARATION!

The Minister of Finance Mr.Christos Staikourasinformed the president of POMIDA Mr.Strato Paradia about his initiative, together with the compensation for the month of February, to be paid to the bank accounts of the lessors within April, and the compensation for the month of March, automatically, i.e. without the obligation of the owners to submit a declaration of COVID on the AADE platform for this month.      

The Minister announced that the support measures regarding real estate leases, which applied in March 2021 for “closed” businesses, will continue in April. In particular, the owners, natural persons and legal persons who lease properties to these businesses, will be paid compensation at 80% and 60% respectively of the rent.

POMIDA TO AD. GEORGIADI: PROFESSIONAL LEASES: HOW TO SUPPORT THE TENANTS, WITHOUT DESTROYING THE OWNERS!

POMIDA’s strong opposition to any consideration of a forced extension of commercial leases due to the pandemic – which affects not only tenants but also landlords – is expressed by POMIDA in a letter to the Minister of Development and Investments Mr. Adoni Georgiadis, regarding relevant information.

POMIDA underlines that if the government insists on proceeding with taking such measures, a series of conditions should be set that will protect both the owners from the risk of returning to post-war tenements and the professionals who have privately owned professional housing from unfair competition, such as:

RENT REDUCTION: THE MARCH 2021 CAD FOR CLOSED & FORECLOSED BUSINESSES!

Decision A.1063/2021 was published in the Official Gazette, which specifies the March 2021 KAD for the compulsory exemption of closed and affected businesses from the obligation to pay the total rent or 40% of the total rent for the month of March 2021. The decision provides in detail the following:

RENT REDUCTION: THE FULL SETUP FOR REDUCTIONS FROM MARCH 2020 TO MARCH 2021!

KYA Α.1059/2021 was published in the Official Gazette amending KYA Α.1228/2020 on the subject “Regulation of special issues regarding more specific terms and conditions for the application of provisions regarding the partial payment of rents in the context of the measures related to the spread of the COVID-19 coronavirus”, and which now after the amendment fully covers the rent reduction framework from March 2020 to March 2021. This decision is as follows:

VESYROPOULOS: FROM TODAY THE PAYMENT OF 80% OF RENTS FOR JANUARY 2021!

From today Tuesday evening the compensations for the total rent exemptions of last January will start to be credited to the bank accounts of the owners,while from tomorrow, Wednesday , the outstanding amounts for the reduced rents for the months of November and December 2020 will begin to be paid.

This was assured to the President of POMIDA by the competent Deputy Minister Finance Mr. Apostolos Vesyropoulos in today’s communication, adding that the payments that will be made will exceed 70 million euros and will concern more than 150,000 TINs, while after the stage of corrections, the liquidation and realization will follow of offsets with tax obligations, compensations for the months March to October 2020. He also informed him that on Friday 19.3, 8 million euros were paid to 119,440 landlords for compensations for partial reductions (40%) of January rents, which will continue today.

LETTER OF POMIDA TO THE MINISTER: TO ALLOW OBJECTIONS FOR ALL THE REFORMED FOREST MAPS!

With the recent circular of the Deputy Minister Mr. G. Amyras on the subject: “Posting reformed forest maps, in application of par. 10 of article 48 of Law 4685/2020”, according to to which “only the reformed part of the forest map accepts objections”, a significant number of property owners throughout the country were deprived of the right to object against the reformed forest maps that were posted, obviously contrary to the legislative provision and the relevant ministerial decision Hatzidakis, but and absolutely unfair and consequential, in relation to earlier circulars of the Ministry.

In a letter to the political leadership of the Ministry, POMIDA requested that the above circular be corrected, defining expressly that objections are allowed for all forest maps, after their reformation.

POMIDA TO AP. VESYROPOULO: RENT REDUCTIONS: RESOLVING PENDING PENDING & NEED TO INTERVENTION IN REGULATING PROPERTY SUBLEASES!

Letter to the Deputy Minister of Finance Mr.Apostolos Vesyropoulossent by POMIDA regarding the resolution of the outstanding issues in the process of calculating and paying the compensation of property owners from the continued reduction of rents, and the disengagement from the problem with real estate subleases.

Specifically in addition to requests to submit initial March-October COVID declarations, the acceptance and out of court for the postponement of taxation of uncollected rents for 2020, and the explicit mention in the rejection messages that the tenants are obliged to pay the entire rent, with the letter it is proposed to improve the relevant arrangements for reductions and compensations on subletting properties in which closed or affected activities.
