Joint proposal of POMIDA – Notaries for declaration of non-debt of co-users in the transfer contracts of horizontal properties

The attachment of a responsible declaration by the administrator to each apartment transfer contract, etc. that there is no pending debt for shared expenses related to the transferred property to the management of the apartment building, or, if there is no administrator or he refuses to issue the above responsible declaration, registration of a responsible statement of the seller to the notary with the above content, the President of POMIDA Mr. Stratos Paradias and the President of the Coordinating Committee of Notarial Associations of Greece Ms. Lena Kontogeorgou requested from the political leadership of the Ministry of Development in a joint letter, in order to address the problem of non-payment of large sums of common use by, mainly foreigners, sellers of apartments, with the result that the unpaid amounts by them unfairly burden the other co-owners of the apartment buildings.

The new tax regulations for real estate, three-year tax exemption for vacancies, etc.

12 tax reductions and measures to boost citizens’ incomes, as well as the imposition of a climate crisis resilience fee on tourist accommodation per daily use and per room or apartment, following the Prime Minister’s announcements at the TIF are included, among other things, in the draft law of the Ministry of National of Economy and Finance that will be immediately put to public consultation. The bill, titled “Income Enhancement Measures, Tax Incentives for Business Innovation and Transformations and Other Provisions”, also includes reforms that modernize tax legislation, such as the new framework for submitting tax returns with discounts for consistent and penalties for government officials and companies that will delay in transmitting the necessary data to AADE.

The Law on Contract Corrections and Unilateral Modifications of Horizontal Properties

Law 5142/2024 of the Ministry of Digital Governance was published in Official Gazette A΄/4.10.2024, which satisfies a series of requests and proposals of POMIDA, in order to resolve the very serious problems of real estate owners regarding their real property titles, with particular emphasis on the possibility of unilateral amendments to deeds establishing horizontal ownership and the possibility of removing the nullity of transfer contracts through the subsequent subjugation of their arbitrariness and unilateral correction of their property titles, but also to institute measures to speed up the processes of completing the land registry, correcting incorrect entries and transferring real deeds.

STP on Fire Protection Regulation: Constitutionally unacceptable transfer of property and environment protection responsibility to private individuals

In a recent letter, the Citizen’s Advocate, Mr. Andreas Pottakis, brought to the attention of the competent ministries his observations regarding the issues raised by the implementation of the KYA YPEN/DAOKA/55904/2019 /19.05.2023 (Government Gazette B’ 3475/24.05.2023), in which it typically states that it is not constitutionally acceptable (Articles 24 and 17 of the Constitution) to transfer, to a large extent, the responsibilities of protection of property and the environment from the fires to private individuals, with excessive, indeed, financially burdensome conditions for them.
