SUBJECT: S.N. MINISTER: POMIDA’s proposals for the Land Register and off-plan building.

Dear Minister, Deputy Ministers,

In view of the preparation and submission of the zoning bill of your Ministry, the need to speed up the process of preparing the Land Registry without hundreds of thousands of objections and lawsuits throughout the country, without unjustly losing property rights of citizens and the better utilization of the hundreds of thousands of undeclared properties in the Land Registry, we consider it necessary and useful to once again bring to your attention briefly our proposals regarding the property rights of property owners in our country:

  1. Immediate legislative solution to the ownership problem of the country’s off-plan properties, with a provision that the State cannot claim property rights over them if private individuals own them in good faith for three decades with legal titles and conditions similar to Article 4 of Law 3127/2003 for properties within the plan.  If this time-consuming problem is not solved, the Cadastre will not be completed in the foreseeable future!!!
  2. Annual extension until 31.12.2021 of the deadline for judicial correction of all inaccurate first entries in the Cadastre offices of of the country,including those inexplicably excluded from the general extension of “unknown owner” properties in 35 Municipalities and regions of the country (Vrilissia, Elefsina, Astros, Kalamaria, Goumenissa, etc.), with already operating cadastral offices, only for those have legal title deeds.
  3. Citizens’ right not only to compensation but also to the complete return of their property, after the expiry of the above deadline for judicial correction of first registrations.
  4. Transfer of undeclared and unknown property owners to the Municipalities of the country, as amended by Article 9 of Law 2664/1998, and not to the State. The Municipalities, first of all the Municipality of Athens, know, can and will utilize the urban properties for the creation of “social housing” and the rural properties for the rehabilitation of farmers’ land, in contrast to the State which is completely unable to utilize them and is at risk of ending up in the Superfund !
  5. Final withdrawal from this bill, of the provisions on the repeal of the current provisions on off-plan legal construction, the constant reinstatement of which is a factor of permanent insecurity and concern of the owners for the value and fate of their property, which was acquired through hard work, deprivation, sacrifice and sacrifice, and is protected by the Constitution and international treaties.
