The report that was republished in many Mass Media reports that in the latest newsletter of its magazine THE NEWS OF PROPERTY OWNERS, POMIDA, with its historical retrospective, provides an overview and brief record of all that it has achieved at a legislative and organizational level in favor of the country’s property owners.

Lease legislation

Especially, as POMIDA states, regarding the tenancy legislation has achieved, among others, the decriminalization of exceeding the fair residential rent and the establishment of a 4.5% minimum rent in residential tenancies (1984), the possibility of owner occupancy in commercial residential tenancies (1989), the establishment of a 6% minimum rent in commercial tenancies (1991), the liberalization of listed and large housing estates (1991), the gradual liberalization of commercial leases (1994-97) and the gradual liberalization of residential leases.

Also, it has succeeded in establishing a rapid procedure for the dismissal of difficult tenants (1997), preventing the imposition of tenancy due to the earthquake in Attica (1999), establishing serious conditions for the reduction of professional rents by Settlement Committees (2011), accelerating & improving the procedure for removing troublesome tenants (2012), limiting landlords’ liability for storage to six months, liberalizing new commercial leases and limiting the protection of old ones (2014) and in 2016 the statutory recognition of short-term residential leases.

Tax legislation

In the field of tax legislation-municipal fees he has succeeded the first abolition of the Real Estate Tax (1980), the proposal for the VAT exemption for the purchase of a first home, the return of VAT declarations (1982), the increase of tax-free VAT (1987), the second abolition of the Real Estate Tax (1992) , the reduction of objective property values ​​by 40% (1993), as well as the reduction to 20% of municipal fees for “closed” properties (1996). Also the non-submission of tax calculation forms by natural persons (1998), the tax exemption of house rentals to earthquake victims (1999), the mass appeals of OTA & revocation of the new increase in objective values ​​(2002), the complete exemption of “closed” properties from municipal taxes (2005), the substantial “abolition” of the inheritance tax-parental provision of properties (at a rate of only 1%!) (2006), the third abolition of the Real Estate Tax (2008), the automatic “closing” of the 1997-2008 VAT cases, the inheritance tax not exceeding – gen. provision by the FMA (10%) (2010), the exemption of non-electric and communal properties from EETIDE (2011), and the reduction of ENFIA by 20% for vacant and non-electric properties (2014).

He also requested and succeeded in suspending capital gains tax – presumptive buyer based on transfer contract value (2014), the explicit clarification that owner-occupied housing does not generate real estate income (2015), the reinstatement the possibility of assigning uncollected leases, the permanent legislative establishment of the deferral of taxation of uncollected leases (2016), the new legalization of the exemption of vacant and non-electrical properties from municipal fees (2018), (KEDE platform), the 40% tax deduction for works energy, operational & aesthetic upgrading of buildings (2019), the deletion of all retroactive charges of municipal taxes and fees (KEDE platform) and in 2020 a compensatory return of 30% of the rent reduction due to COVID-19 (AADE platform).

Urban-planning, technical and institutional issues

In urban-planning, technical and institutional issues, among others, he succeeded in the period 1996-98 in the Land Registry the intervention for the non-abolition of mortgages, in 2001 the intervention in the revision of the Constitution for expropriations – requisitions, in 2003 the disengagement of urban plots from the confiscation forest provisions and in 2003 the resolution of the ownership problem of the properties within the plan . Also in 2009, he succeeded in establishing reasonable rules for the renovation of old elevators, in 2009-2010 the establishment of the possibility of arranging semi-outdoor spaces, followed by the establishment of the possibility of arranging arbitrary spaces, the abolition of the minimum cost of energy certificates, the intervention in residential leases for hosting refugees, the narrowing of the “identity of building” and nullity of leases provisions and the establishment of the “identity” of individual horizontal property.
