SUBJECT:EXTENDING DEADLINES FOR DECLARATION OF SQUARE, ARBITRARY & KIMATOLOGIOU
Dear Ministers
The unprecedented situation in which the country found itself us and its citizens during the current year, due to the corona virus epidemic, combined with the real weakness of the professionals (engineers, tax experts, lawyers) who handle the issues of private real estate – due to the overloading or shutdown of the respective of electronic platforms – to meet their duties, imposes the immediate extension of the statutory deadlines for various vital matters of your competence concerning the property owners of our country, as well as the extension of the operation of the corresponding electronic platforms. Specifically
A. DECLARATION OF SQUARES & NON-ELECTRICAL PROPERTIES. The provisions that will automatically come back into force from 1.9.2020 onwards are completely unenforceable, given that they provide for :
– Fines of 60%, 100% and 200 % in undeclared areas, five times in commercial use.
-Complete “trap” in excruciating municipal fees in vacant and unelectrified spaces, for those owners who are unaware that exemption from them it will be valid only from the day of submission of the declaration to the Municipality.
– Rolling up to 20 years gradual limitation of taxes, fees, rights and contributions to the OTAs, increased by the fines on the debts of the last five years (article 32 of Law 4304/2014!!!).
-From 1.10 telephone appointments and queues for every contact with the revenue services of the Municipalities!
The operation of the KEDE platform should therefore continue without interruption, with very low fines, gradually increased, for those owners who delay, as is done with the arbitrarily!
B. STATEMENT OF VOLUNTEERS. The deadline for the legalization of all types of illegals must be extended until 31.12.2020, and then only really large and independent illegals should remain in category 5, and not minor violations in licensed buildings, a very common phenomenon in cases of illegal constructions in areas with a small percentage of co-ownership on the plot.
C. NATIONAL LAND REGISTRY: EXTENSION OF DEADLINE FOR CORRECTION OF INACCURATE FIRST DOCUMENTS. Article 102 of Law 4623/2019 set 31.12.2020 as the deadline for correcting the initial entries in the National Land Registry, after which private individuals permanently lose all their undeclared ownership rights, while the State is entitled to claim of each property declared by a private individual for another two years! This deadline was excessively shortened for certain regions of the country, such as Heraklion, Crete, while the extension of the deadline for claiming real estate by the State is being discussed!
That is why we also propose we request the annual extension until 31.12.2021 of the deadline for correcting ALL inaccurate first registrations in the Land Registry Offices of the country, including the inexplicably excluded from the general extension of “unknown owner” properties in 35 municipalities and regions of the country (Vrilissia, Elefsina, Astros, Kalamaria, Goumenissa, etc.), with already operating cadastral offices.
That is why we invite you, Mr. Ministers, do not lead the citizens to dead ends, and respond to the appeal of our organization, but also of all interested professional organizations, and extend the relevant deadlines, for the benefit of society, the economy and the OTAs of the country.
