POMIDA SUCCESS: REFUND OF MUNICIPAL FEES UNFAIRLY COLLECTED IN JANUARY 2022!

The relevant provision is as follows:

Article 44

Submission of data declarations for the determination of the area or the use of the property – Validity Article 66 of Law 4830/2021.

Article 66 of Law 4830/2021 (A’ 169) also covers the declarations for determining the area or the use of a property with correct data that were submitted during the period from 1.1.2022 to 23.3.2022, i.e. the previous date of publication of Law 4915/2022 (A’ 63). Amounts paid by citizens, in addition to what is owed, in accordance with articles 66 of Law 4830/2021 and 18 of Law 4915/2022, are returned upon their request.

Dear Mr. Minister

From the attached documents from 5.4.2022 of the Revenue Department of the Finance Directorate of your Ministry, you will see that a very serious problem is being created, due to the blatantly incorrect misinterpretation of the recent regulation that you proposed to the Parliament for undeclared square footage (article 18 of Law 4915/24.3.2022). the “by 30.6.2022”, covering all those who have made or will make declarations by 30.6.2022, your agency claims that those who submitted declarations before its publication are not covered of law (ie for the interim period 1.1 to 24.3.2022) and therefore all of them have to pay retroactive fees of 14 years, plus the heaviest prescribed fines, surcharges, etc.!!!

This interpretation is not only completely wrong, but it is also literally oppressive for the citizens, since it simultaneously violates the elementary rules of good administration, attempting to introduce adverse regulation to the detriment of those citizens who hastened previously to the Municipalities to obtain certificates for drawing up legal acts with the old objective values, and creates justified protests of unequal treatment, but and cancellation of contracts, legal disputes, etc.

That is why the Municipality of Athens, which has a long tradition of respecting its citizens, precisely for reasons of good administration, in honor of its leadership and services, applies this provision indiscriminately for all citizens, without unfairly “punishing” those who submitted their statements earlier, before the publication of the above provision.      

In view of the above, I ask you for your immediate intervention to issue a statement clarifying that the new regulation covers all declarations of undeclared square footage that will be submitted by 30.6.2022, without excluding the citizens who submitted such declarations previously.
