EXTENSION UNTIL 31.7 OF NON-PAYMENT OF RENT AND DECLARATION OF PROFESSIONAL LEASES!

The new law 4818/2021 was published in the Official Gazette, which among other things extends the possibility of exemption from the payment of July rent for certain specific professional activities that are still affected by the measures for the corona virus, which will be determined by the July 2021 KYA of the KAD.

Also with the same by law, the deadline for tenants to file for extensions of government-mandated business leases, as long as the tenants are in arrears, isextended to July 31, 2021.

AT A PUBLIC CONSULTATION, S.N. FOR ESTATE AND THE NEW DIGITAL SERVICES!

The Minister of State, Mr.Kyriakos Pierrakakisput the draft law of the Ministry of Digital Governance entitled:“Modernization of the Greek Land Registry, new digital services and strengthening of digital governance”.

This draft law attempts to:
a) the acceleration of the completion of the real estate registration processand the transition to the status of a functioning Land Registry, the streamlining of the procedures for correcting the first inaccurate cadastral records and the modernization of the operation of the n.p.d.d. “Hellenic Land Registry” (Part A’),
b)the creation of new digital public services provided to citizens and businesses through the Unified Digital Portal of the Public Administration (Part B΄), and
c) the strengthening of digital governance through the regulation of issues of organization and operation of the Ministry of Digital Governance, its supervised entities and the National Telecommunications and Posts Commission (ETT .) (Part C’).

NEWS REGARDING ANTIQUITY IN THE OBJECTIVE VALUES OF BUILDINGS!

With the Joint Ministerial Decision 60449 EX 2021 (Government Gazette 2146/Β/24-5-2021), a significant amendment was made to the under data 1067780 /82/ Γ0013/09.06.1994 (POL.1149) of the decision of the Deputy Minister of Finance “Amendment, improvement and codification of the provisions concerning the taxable value of property transferred for any reason within a plan, according to the objective system” (B’ 549) and the under data 1129485/479/Γ0013/03.12.1996 (POL.1310) of the decision of the Deputy Minister of Finance “Determination according to article 41a of the law 1249/1982 with objective criteria, the value of real estate buildings, which are located in areas where the objective determination system does not apply” (B’ 1152). In this decision, among other things, regulations are particularly unfavorable for listed buildings, since if they are radically renovated (?) they will be considered as completely new…

RENT REDUCTION: THE MONTH OF MAY 2021!

Published on 25.5.2021 the decision A.1114/2021 “Identification of affected businesses for the mandatory exemption from the obligation to pay the total rent for the month of May 2021”, whereby the reduction of professional rents is limited only to the category of full exemption from the rent (40% reduction does not apply to May), which states in detail the following:.

AADE: ONLY WITH BANK PAYMENT THE DISCOUNT OF PROFESSIONAL RENT EXPENSES!

Rents of business premises are recognized as a legitimate business expense only if they have been paid by bank – electronic means, and not in cash. This is provided for by the decision of the AADE (E.2109/2021) published in the Official Gazette, in accordance with the provisions of article 23 of Law 4172/2013 (A’ 167), as amended by Law 4646/2019 (A’ 201 ).

RENT REDUCTION: APRIL 2021 CLOSED & FORECLOSED BUSINESS CADS!

Decision A.1101/2021 was also published in the Official Gazette, with its object being the identification of affected businesses for the mandatory exemption from the obligation to pay the total rent or 40% of the total rent for in the month of April 2021. An important difference compared to the KADs of previous months is the reclassification from the category of “closed” to the category of “occupants” who are entitled to a rent reduction of only 40% of the following KADs, which were in operation during during April:

NEW CIRCULAR FOR FOREST MAPS: GRASSLANDS AND NEW OBJECTION COMMITTEES!

The areas with grasslands will be properly considered grassland, and not forest, giving a way out and hope to 170,000 owners whose objections will be decided by the new Objection Examination Committees, a new circular of Ministry of the Interior signed by the general secretary of Natural Environment and Waters of the Ministry of the Interior, Mr. Konstantinos Arabosis.  In the circular, instructions are given that the Commissions should not consider ownership rights of the State or private individuals and to apply the “Famellou circular” of 2019, which provides for the grassland areas to be registered as grassland.

IN JUSTICE THE CASES OF DESTRUCTION OF SUPPORT MEASURES!

Better late than never!!! The Ministries of Finance and Labor and Social Affairs are sending to the Court of Justice cases of possible circumvention of measures to support the economy and society from the consequences of the corona virus, the victims of which are not only the State, but also a large number of lessors of real estate and mainly houses in across the country, who suffered unfair wage reductions from virtual suspended positions of workers who are working normally, in collusion with a portion of employers.  An investigation has already been ordered and is being carried out specifically for this specific type of circumvention, which was widely used in the province where controls were rare or even non-existent, and was limited only after the immediate intervention of the Minister of LabourMr Kostis Hatzidakis strong>immediately after this year’s POMIDA Panhellenic Congress where we raised the issue, which banned the retroactive positions of suspended employees.

KYA FOR 40% OFF BUILDING UPGRADE COSTS!

Another proposal of POMIDA is on its way to implementation, with a long delay, and not to the extent we had proposed so that it could effectively contribute to the energy and functional upgrading of its buildings of our country, for which there is a huge need.

KYA 1090/2021 (Government Gazette 1636/B/22-04-2021) was finally published in the Government Gazette which determines the conditions, terms, procedure and any other necessary detail for the implementation of the provisions of article 39B “Tax deduction for expenses related to receiving services for energy, functional and aesthetic upgrading of buildings” of Law 4172/2013, regarding the application of the deduction from the personal income tax of the costs for receiving energy, functional and aesthetic upgrading services of buildings carried out during the year 2020.
