POMIDA: INCREDIBLE BURDENS FROM THE ADDITIONAL ENFIA! EXAMPLES AND MODEL FOR “VISIBLE REFUGEES” UNTIL 10.6.2022!

The protests of owners from Attica, but also other parts of the country, are intensifying for the multiplication of the ENFIA tax on owners from all over the countrywho have rights in properties worth more than 400,000 euros each, in relation to owners who own property of equal value but distributed among several properties of lesser value, but also those who have property exceeding 500,000€.

The situation is not rectified by the “firefighter” exemption of plots of land up to 5% which concerns a minimum number of owners, and, combined with the huge rise in property values, leaves tens of thousands more exposed to confiscatory overtaxation , who are called upon to finance in a bloody way the reductions of the balances…

As we emphasized, these arrangements violate article 4 of the Constitution which stipulates that all Greeks participate in the public burdens without discrimination and according to their strengths, which the Scientific Service of the Parliament also pointed out in its report. They also violate Article 21 for the protection of the family since they introduce a targeted burden of overtaxation of the family property, taxing each member of the family – an undivided co-owner, calculating an incremental rate as if each owned the entire property.

POMIDA: IMMEDIATELY ABOLISH THE UNCONSTITUTIONAL BURDENS OF ENFIA 2022. “CEILING” ENFIA 2021. “CERTIFIED REFUGEES” UNTIL 10.6.2022!

Unfair but also unconstitutional is the double different treatment reserved by the new ENFIA law (2022) for the property owners, burdening even tens of thousands of euros per year to those who have properties worth more than 400,000 euros each, in relation to owners who own property of equal value but distributed among several properties of lesser value each, but also those who have property exceeding €500,000, in combination with huge regional increases in the objective values ​​of their properties, and especially (unprofitable) urban plots, which lead to literally “crazy” tax charges!

POMIDA: DESPITE THE “FACE LIFTING”, THE NEW ENFIA REMAINS A HEAVY AND UNFAIR TAX!

POMIDA announces the following:

From the first evaluation of clearing papers of the new ENFIA 2022 the following initials result conclusions:

1. A significant percentage tax reduction is observed for taxpayers with assets of small value each, and most of whom have until now had relatively small or even insignificant tax liabilities.

2 . But a significant portion of long-suffering “middle class” taxpayers are facing a huge tax increase, with the main cause being the unrealistic increase in zone prices from 1.1.2022 in many areas, which was based on pre-coronavirus data, which for most is regardless of today’s reality.

THE NEW ENFIA: HOW TO PRINT ITS CLEANER!

The charges of the new ENFIA 2022 have been posted in the “Personalized Information” of taxpayers.

The process of posting the bills will take hours as there are more than 7 million bills. However, if the owners want to know immediately what is the amount that has been confirmed to them, but also the amount of installments they are required to pay, they can see it in the “Certified Debts” application, as it is already written there and the total amount with which is borne by each owner as well as the amount of each installment.

From this year the ENFIA payment will be made in 10 installments, the first of which will must be paid at the end of the current month of May and the last at the end of February 2023, according to an amendment tabled in Parliament. The one-time payment of the entire tax does not entail the slightest deduction! Another expression of the thankless nature of this onerous tax, which in the minds of most taxpayers is equivalent to paying monthly…rent for their own house…

THE DEADLINE FOR REGISTRATION OF ELEVATORS IN THE COUNTRY HAS BEEN EXTENDED UNTIL 31.12.2022!

With the decree numbered 45059/6.5.2022 of the Ministers of Development and Energy (Government Gazette B΄2230), one more request of POMIDA, which was presented through the Working Group for the Elevators of YPAN in which it has been participating for a number of years, together with all the agencies involved.

Specificallyit was extended for another year (until 31.12.2022 ) the deadline for registration of the installed elevators of the country’s buildings, which had expired on 31.12.2021. It is recalled that the registration process presupposes the inspection of the installed lifts by a recognized body, the performance of the upgrade works and the re-inspection, and finally their legal registration. The latter seems that very soon it will now be done in the electronic National Register of Elevators, which is expected to be put into operation within the next few months.

3% CEILING ON PROFESSIONAL LEASES: WRONG METER WITH WRONG MESSAGE!

Law 4926/2022 was published, article 121 of which provides for a maximum rate of increase (3%) of rents in commercial leases for the year 2022. The content of the provision is as follows:

“Article 122. Determining the upper limit of rent adjustment for commercial and professional real estate leases for the year 2022.

1. For real estate leases that fall within the scope of Law 34/1995 (A’ 30), as well as Article 13 of Law 4242/2014 (A’50), from the 1st of January 2022 until the 31st of December 2022, an adjustment of the rent amounting to a maximum of three percent (3%), on the rent of the year 2021, is allowed.

2. Paragraph 1 covers rent adjustments that take place after 1.1.2022 and until the entry into force of this.

POMIDA – PURCHASES: SIGNING OF CONTRACTS UNTIL 31.5.2022 BASED ON ENGINEER’S CERTIFICATES UNTIL 31.3.2022!

In order to immediately solve the problem of 15-20,000 “trapped” citizens due to the inability of the state services (Municipalities and D.O.Y.) to issue the necessary documents, it seems that the competent government agents are oriented, following the letter from 11.4.2022 sent by the presidents of the property owners Mr. Stratos Paradias and the notaries Mr. Giorgos Rouskas, in order to give to the citizens who could not complete their real transactions until 31.3 .2022 due to the workload of the government agencies, the possibility of drawing up real estate transfer contracts until 31.5.2022 based on engineer’s certificates that were legally issued until 31.3.2022.

TAP CONFIRMATION: ITS NEW RELEASE SETTING!

With article 76 of Law 4921/18.4.2022 (Government Gazette A΄75), the procedure for issuing the Municipality certificate of non-payment of TAP was changed again, after the protests and the abstention of the notaries due to their involvement in the guarantee procedure. Although the existence of the certificate remains as a prerequisite for the drawing up of a transfer contract, and indeed on penalty of its invalidity, nevertheless the important positive elements of the new regulation already in force for citizens are the following:

* the annual duration of the certificate,

* the charge and payment of only the TAP,

* the retroactivity of charges only for one five years,

* the abolition of the de facto arbitrary refusal to grant this certification.
