“In a brief assessment of the announcements about ENFIA, and without knowing the details in which we all know …who is hiding, we note the following:

The main positive elements for taxpayers of the new arrangement seem to be the following:

The reduction of the overall burden on society by ENFIA by 350 million . in relation to 2021 and 920 million in relation to 2018.

The de facto recognition that the additional property tax was a historical injustice against a broad category taxpayers who literally “killed” to pay it for eight years, and its abolition as an independent second tax within the ENFIA on the entire property.

The increase and expansion of tax deductions for broad categories of taxpayers with social criteria.  

The reduction of the basic rates of taxation of buildings and plots, if they include all buildings and all plots.  

The increase in the number of tax payment installments.

POMIDA TO THE MINISTER: REQUEST FOR EXTENDING THE VALIDITY OF THE ENGINEER’S CERTIFICATE UNTIL 31.3.2022!

The Ministry of Foreign Affairs granted a two-month extension for the process of real estate transfers through an engineer’s certificate, responding once again to POMIDA’s request. 

signing real estate transfer contracts with the old objective values, respectively and the Ministry of Environment and Energy gives a two-month extension until March 31, 2022 to the possibility of completing real estate transfers through an engineer’s certificate without the obligation to draw up an Electronic Identity Building. The Deputy Minister of Spatial Planning and Urban Environment, Nikos Tagaras, stated:

“Taking into account the special conditions prevailing in the market, we enable the orderly completion of real estate transfers in a reasonable period of time, through the engineer’s certificate. At the same time, I must point out that the Electronic Building Identity has been fully operational since the beginning of 2021 and already about 20,000 real estate registrations have been made”.

THE 39TH POMIDA CONFERENCE: COMPLETE AND FINAL ABOLITION OF THE ADDITIONAL TAX ON ENFIA IN ANY FORM!

The 39th Panhellenic Property Owners Conference was held with great success. Positions of the representatives of the government and the opposition.

The commitment to reduce the ENFIA for most – as he said – taxpayers was pointed out by the Minister of Finance Mr. Christos Staikouras today, speaking at the 39th Panhellenic Conference of Property Owners of POMIDA, which took place today, Saturday January 29, in the “Mercury” room of the Athens Chamber of Commerce and Industry. At the same conference, the Deputy Minister of the Interior, Mr. Stelios Petsas, committed himself to the satisfaction of a series of requests by POMIDA, including the abolition of the TAP certificate when drawing up transfer contracts, the Secretary General of Forests, Mr. Konstantinos Arabosis announced the filing of legislation for forested fields while the AADE commander Mr. Giorgos Pitsilis announced that in 2022 they will join the myproperty platform, (through which the electronic property transfers), inheritances and informal donations.

POMIDA TO AADE FOR VAT MANAGEMENT OF APARTMENT HOUSES AND SELF TAXATION OF INCOME OF APARTMENT HOUSES!

POMIDA sent a letter to the Governor of AADE, Mr. Giorgos Pitsilis, on the occasion of the announcement that the issuance of a decision is imminent which will facilitate the issuance of the VAT number of the management of apartment buildings without a deadline and without a fine, which he characterizes as important and especially timely in view of the submission of applications for subsidies for apartment buildings from the new “I SAVE”, and the resulting need to open management bank accounts and also for the allowance heating.  

With its letter, POMIDA presents two of our proposals concerning the management of apartment buildings in the hope of their adoption.

MINISTRY: AMENDMENT FOR EXTENSION OF THE ENGINEER’S CERTIFICATE UNTIL 31.1.2022!

Justification of the hard struggle of POMIDA and the other organizations that mobilized, recommends the amendment of the Ministry of Foreign Affairs that was included in the article 73 par. 4 of the law 4876/2021 on the pandemic, according to which it will be allowed to draw up notarial acts of transfer of real estate with a simple engineer’s certificate until January 31, 2022, and not necessarily with an electronic building identity.

LETTER OF ANNOUNCEMENT TO FINANCE FOR THE OUTSTANDING COMPENSATIONS OF PROPERTY OWNERS FROM THE RENT REDUCTION!

POMIDA sent a letter to the political leadership of the Ministry of Finance and the AADE on the occasion of the recent decision A.1225/2021 of the Governor of the AADE by which new deadlines are given for declarations of lessors of sublet properties , which inevitably foreshadows a new delay in the payment of compensations, but also the constant protests of real estate lessors and their tax experts from all over the country that their legally prescribed compensations have not been paid even though there is no formal omission on their part.

REQUEST OF BODIES FOR THE EXTENSION OF THE CURRENT PROPERTY TRANSFER SYSTEM!

The Coordinating Committee of Notarial Associations of Greece (SESSE) and POMIDA issued the following announcement:

With the from 08.12.2021 joint request of the Plenary Assembly of the Bar Associations of Greece, the Coordinating Committee of the Notarial Associations of Greece, GSEVEE, OMCOE, OMASE and POMIDA, i.e. all the Bodies we are associated with transactions and legal transactions on real estate, we had pointed out in time the System’s inability to respond to the huge demand, caused mainly by the increase in property values ​​since the new year, for real estate transactions until the end of the previous year. In order for the system to be able to respond to the increased demand for real estate transfers within a reasonable period of time, we proposed a six-month extension of the current real estate transfer framework until 31.12.2021, pointing out that the Greek State has much more to gain from this extension, as it will collect income from the transactions that will be completed, while on the contrary, many unfinished notarial acts will be referred to the “Greek Calendars” as they will no longer be considered profitable for the transactions.

AADE: NEW DEADLINES FOR SUBLET PROPERTIES COVID DECLARATIONS!

In order to speed up the payment of compensations based on COVID declarations concerning real estate subleases, by decision of the Governor of the Independent Public Revenue Authority Mr. Giorgos Pitsilis announced on 20.12.2021 the following are provided for:

– from on December 21, 2021 until January 10, 2022, landlords of properties, whose properties have been sublet, can submit an initial or amending “Covid Declaration” and/or amending (not initial) “Property Lease Information Statement” for the months of November 2020 through July 2021.

MINISTER: NEW INSTRUCTIONS FOR THE IMPLEMENTATION OF THE FOREST LAW AND PROPERTY RIGHTS!

Published in “Diaygeia” (PSPSHIK4653Π8-BDE) the Circular ΙΠΕΝ with number 115255/6217/2021 and with the subject “Instructions for the implementation of the provisions of case IV of par. 1 of the article 10 of Law 3208/2003 and Article 8A of Law 998/1979, which was added by Article 149 of Law 4819/2021”, with important new regulations that satisfy some of POMIDA’s requests in relation to private real rights and is signed by the General Secretary of Natural Environment and Water Resources Prof. Mr. Kon.
