Topic: Transfer of real estate with retention of ENFIA debts by the notaries!
As is well known, for any debt owed to the State, the legislation gives the possibility to transfer a property, under the condition of withholding the entire debt of the seller, as it appears from a relevant certificate of Head of the competent D.OY. protests from citizens from all over the country, who are in a desperate financial situation and need to sell their properties, which is impossible, due to the fact that ENFIA debts are excluded, unknown why, from this simple procedure!
Specifically, Article 54A of Law 4174/2013 imposes a long and torturous procedure that oppresses real estate sellers, for drawing up even a simple sales contract , according to which the seller is required to:
- First of all submit all of his debts to the fixed arrangement of 12 monthly installments.
- Secondly, to find money and pay within three days of the settlement, the first installment corresponding to 1/12 of his total debt.
- Thirdly, to wait until the payment appears in the electronic system.
- Fourthly, to submit an application to the DOU to be granted, after a few days, a handwritten ENFIA certificate with the details of the notary who will draw up the contract and the amount he will withhold and return.
Because following the above process is unbearably time consuming, and unacceptably delays transactions, but also complete prohibitive, given that if the sellers had money to pay taxes they would not sell their property, or if they had it in the Bank the State would have confiscated it, in the context of reducing bureaucracy in real estate transfers and facilitating citizens, you we ask for the self-evident: The debt for ENFIA be paid like any other debt of the property seller, i.e. with withholding of the total amount by the notary, without the prerequisite of its settlement and advance payment of the first installment of the settlement amount !
