QUESTION OF THE THESSALONIKI MP DIMITRIS KOUVELAS ON THE EXTENSION OF THE DEADLINE OF L.4759/2020!

In December 2020, theN. 4759/2020 which concerned the “Modernization of Spatial and Town Planning Legislation“. The provisions of the Law set restrictions on off-plan building in order to limit unregulated building and protect the environment for areas where there is no first-level urban planning. With regard to building with residential use, the Law abolishes the deviations for the off-plan for plots of 750 sq.m., 1,000 sq.m. and 2,000 sq.m. and now sets as buildable plots with a minimum area of ​​4,000 sq.m. These provisions give citizens the opportunity, from the day the Bill is passed, for a period of two years, i.e. until December 2022 , to issue a building permit to these properties which are to be considered unbuildable in the coming years. And the building conditions of no. 32, of no. 33 and of no. 34 for the tourist facilities in areas outside the plan but also the transitional – authorizing provisions of the relevant no. 40 of Law 4759/2020, as the Movement for Change had pointed out in time during the discussion of the Bill, had to be clarified and subsequently amended by a series of laws (Law 4764/2020, Law 4819/2021 and Law 4872/2021 ).

The cases of deviations make up a large percentage of properties in off-plan construction. This change will mainly affect micro-property. Despite the amendments to the Law that have taken place and the need to gradually abolish off-plan building in our country, the Government does not seem to understand the particularities of certain areas, let alone when it does not proceed with the necessary actions for the immediate completion of theLocal Town Planning Plans throughout the Territory, in order for the State – to pay the required respect to citizens and to the protection of their property. 

In the time that has passed since the passing of the law on December 9, 2020 and until today, the conditions have not been the most favorable for investments in the construction sector. The effects of the pandemic on the economy, the latest developments with the war in Ukraine, but also the skyrocketing of construction costs, make any thoughts today about the design and construction of accommodation prohibitive. Everyone is waiting for “normalcy” to proceed with such investments. 

Regarding the technical environment, we remind you that to date the final posting of the Forest maps has not been completed, the Cadastre process is progressing slowly and of course, no action has been taken for the drafting of local urban planning plans by the State, as it should.

At the same time, the serious problems of understaffing of the Construction Services in the local areas, where the very large amount of work that needs to be carried out, leads to delays in the issuance of building permits in general but also in particular for the non-planned areas.

In these conditions and in remaining period until December 9, 2022 citizens are invited to issue building permits for their deviatingly buildable properties

THE COMPETENT MINISTER IS ASKED

  1. What is the position of your Ministry on this specific issue?
  2. What is the planning and immediate actions in order to give breathing space to thousands of small land owners in various areas of Greece, which see that they have less than two months to issue the necessary building permit for their reconstruction?
  3. Is there an intention on the part of your Ministry to give new extension of the deadline for the issuance of building permits for deviating buildable properties, if not for two years as requested by POMIDA and TEE, at least for one more year until 9/12/2023?
