NEW KYA FOR ELEVATORS IN PUBLIC CONSULTATION!

The Draft Joint Ministerial Decision to determine the requirements regarding the registration, operation, maintenance and control of installed elevators t began public consultation from Friday, February 4, 2022. The aim of the Ministerial Decision is the complete reformation of the provisions of the existing legislation in the context of our country’s European obligations, alongside the application of rules of healthy and equal competition in the business activity of the said sector which concerns the provision of maintenance services.

The consultation will last until Friday 25/02/2022.

POMIDA TO THE MINISTER: REQUEST FOR EXTENDING THE VALIDITY OF THE ENGINEER’S CERTIFICATE UNTIL 31.3.2022!

The Ministry of Foreign Affairs granted a two-month extension for the process of real estate transfers through an engineer’s certificate, responding once again to POMIDA’s request. 

signing real estate transfer contracts with the old objective values, respectively and the Ministry of Environment and Energy gives a two-month extension until March 31, 2022 to the possibility of completing real estate transfers through an engineer’s certificate without the obligation to draw up an Electronic Identity Building. The Deputy Minister of Spatial Planning and Urban Environment, Nikos Tagaras, stated:

“Taking into account the special conditions prevailing in the market, we enable the orderly completion of real estate transfers in a reasonable period of time, through the engineer’s certificate. At the same time, I must point out that the Electronic Building Identity has been fully operational since the beginning of 2021 and already about 20,000 real estate registrations have been made”.

THE PROCEDURE FOR LOOKING FOR OVERPAID AMOUNTS OF THE LANDLORD’S COMPENSATION!

With the decision no. GDOU 1056/Government Gazette B 5423-22.11.2021 of the Minister, Deputy Minister and Deputy Minister of Finance, the procedure for searching for unduly paid amounts of landlord compensation was determined, as required by law in the context of dealing with the effects of the COVID-19 coronavirus. RESPONSIBLE OWNER DECLARATION AND ENGINEER’S CERTIFICATE AGAINST ELECTRONIC BUILDING IDENTITY UNTIL 31.12.2021!

In response to the public appeals of POMIDA, notaries and the technical world, an amendment was submitted to the bill of the Ministry of Environment and Energy which regulates the following issue:

For the period from 1.10.2021 to 31.12.2021, the framework regarding the drawing up of an Electronic Building Identity does not apply, for any deed in existence with the object of transfer or establishment of a real right to a property or to a property without a building (responsible declaration of the owner and an engineer’s certificate are required).

NEW REGULATIONS OF THE MINISTRY OF P.E.A., GOVERNMENT LEASES, HEATING COSTS AND EXTENSION OF OBJECTIONS AGAINST FOREST MAPS!

Law 4843/2021 of the Ministry of the Interior on the extension of the engineer’s certificate until 31.12.2021 was published in Official Gazette A193/20.10.2021, four-month extension of the deadline for objections against forest maps, new arrangements for P.E.A., leasing of buildings to the State, distribution of heating costs, entitled “Incorporation of Directive (EU) 2018/2002 of the European Parliament and of the Council of 11 December 2018 “relating to the amendment of Directive 2012/27/EU on energy efficiency”, adaptation to Regulation 2018/1999/EU of the European Parliament and of the Council of 11 December 2018 on the governance of the Energy Union and Climate Action and Commission Delegated Regulation 2019/826/EU, of March 4, 2019, “amending Annexes VIII and IX of Directive 2012/27/EU of the European Parliament and of the Council on the content of comprehensive assessments of efficient heating and cooling potential” and related regulations on building energy efficiency sector, as well as the strengthening of Renewable Energy Sources and competition in the electricity market”.

THE SETTINGS FOR “TAX-FREE” PARENTAL BENEFITS – DONATIONS AND CHILDREN 2021!

With amendments of the Ministry of Finance submitted to the draft law “Prevention and response to incidents of abuse and neglect of minors…. and other provisions”, a series of matters of competence of the Ministry of Finance following the announcements of the Prime Minister to the TIF, but also the method of payment of ENFIA 2021. In particular, with article 3 of this amendment, two important regulations are introduced in the way in which the transfer of the property of the Greek family to the next generations:

UNDEFINED SQUARES: THE NEW SETTING!

An amendment by the Ministry of Internal Affairs was submitted to the Parliament with which the KEDE platform for undeclared square meters of real estate will be reopened until 31.12.2021. Unfortunately, this amendment does not include the declaration of non-electric properties, so that they are exempt from municipal cleaning and lighting fees. For this matter, POMIDA has proposed the automatic exemption from these fees, for each property whose electricity supply is interrupted.

RENT REDUCTION: THE CADS OF FILLED BUSINESSES FOR JULY 2021!

Decision A.1167/2021 regarding the determination of affected businesses for the mandatory exemption from the obligation to pay the total rent for the month was published in the Official Gazette July 2021. With this decision, the non-payment of rent is limited to a few categories of businesses, for which various measures limiting their activity are still in effect. In this decision, there is no rent exemption for catering and retail, no partial payment of rents, nor a reduction of residential rents, and therefore the tenants have to proceed with an undecided payment of full rents.
