LETTER OF POMIDA TO THE MINISTER: TO ALLOW OBJECTIONS FOR ALL THE REFORMED FOREST MAPS!

With the recent circular of the Deputy Minister Mr. G. Amyras on the subject: “Posting reformed forest maps, in application of par. 10 of article 48 of Law 4685/2020”, according to to which “only the reformed part of the forest map accepts objections”, a significant number of property owners throughout the country were deprived of the right to object against the reformed forest maps that were posted, obviously contrary to the legislative provision and the relevant ministerial decision Hatzidakis, but and absolutely unfair and consequential, in relation to earlier circulars of the Ministry.

In a letter to the political leadership of the Ministry, POMIDA requested that the above circular be corrected, defining expressly that objections are allowed for all forest maps, after their reformation.

POMIDA TO AP. VESYROPOULO: RENT REDUCTIONS: RESOLVING PENDING PENDING & NEED TO INTERVENTION IN REGULATING PROPERTY SUBLEASES!

Letter to the Deputy Minister of Finance Mr.Apostolos Vesyropoulossent by POMIDA regarding the resolution of the outstanding issues in the process of calculating and paying the compensation of property owners from the continued reduction of rents, and the disengagement from the problem with real estate subleases.

Specifically in addition to requests to submit initial March-October COVID declarations, the acceptance and out of court for the postponement of taxation of uncollected rents for 2020, and the explicit mention in the rejection messages that the tenants are obliged to pay the entire rent, with the letter it is proposed to improve the relevant arrangements for reductions and compensations on subletting properties in which closed or affected activities.

POMIDA TO FINANCE: 2020 RENT TAXATION DEFERMENT WITH EXCLUSION, ALSO FOR 40% DISCOUNT DUE TO UPGRADING WORKS & PAYMENT OF INHERITANCE TAX WITH PROPERTY TRANSFER!

After the receipt comes the tax nightmare for property owners who have received 2020 rents from their tenants but, when it comes to filing income tax returns, are completely unable to follow the applicable process postponement of taxation of uncollected rents, which requires functioning courts and open D.O.Y.  That is why it is necessary, especially for the uncollected rents of 2020, to immediately give the possibility of deferring their taxation only with the notification of the extrajudicial court provided for by article 637 of the Code of Civil Procedure. For the same reason, it is urgent to immediately issue the Decree on the deduction from income tax of 40% of the costs of building upgrade works, while the Ministerial Decision on the payment of inheritance tax with the transfer of property to the State has been unjustifiably pending for many years.

For these issues, POMIDA sent the following letter to the Minister of Finance Mr. Christos Staikouras and the competent Deputy Minister Mr. Apostolos Vesyropoulos.

RENT REDUCTIONS: INITIAL COVID DECLARATION, DEADLINES AND SUBLEASES!

POMIDA sent a letter to the competent Deputy Minister of Finance, Mr. Apostolos Vesyropoulos, highlighting three points in the process of compensating property owners from rent reductions due to COVID, and asking for solutions. with requests:

*To accept not only corrective but also initial COVID declarations for all months of the year 2020, and for all those owners who missed the relevant deadlines ,

*Set at least a monthly deadline from informing owners of errors and reasons for rejection of COVID declarations, and

*To clarify whether rent reductions imposed by sublessors on property owners are legal when the rental properties are used by third-party sublessors.

POMIDA TO THE MINISTER: PARALLEL VALIDITY OF ENGINEER’S CERTIFICATE WITH BUILDING IDENTITY UNTIL THE END OF THE PANDEMIC, REMOVING THE STATIC SUFFICIENCE FOR DISTRIBUTED PROPERTIES & SETTING FOR ARBITRARY CAT5!

The extension of measures against the pandemic, which has as a consequence the difficulty or complete inability of citizens and technicians to access all relevant public services (urban planning, mortgage offices, cadastral offices, municipalities, etc.), combined with the exclusive validity of the building identity from 1.4.2021, turns real estate transfers into a nightmare and urgently raises the issue of reviewing the entry into force of this measure.

 POMIDA TO THE MINISTRY OF FINANCE: THE NECESSARY INTERVENTIONS IN ENFIA AND THE DISTORTIONS OF LAW 4389/2016!

Regarding recent statements by the Minister of Finance, Mr. Christos Staikouras, regarding an imminent new reduction in ENFIA by 8%, which will obviously be accompanied by increases in the property zone prices based on of data collected before the pandemic and therefore today’s completely different reality in the real estate market has not been taken into account, in its letter POMIDA points out what must precede the planned changes in order to fundamentally restore tax justice and logic, but also to ensure the collectability of ENFIA.

POMIDA TO HATZIDAKIS: ESTABLISHMENT OF NOTIFYING RESIDENTIAL LESSORS ABOUT WORK SUSPENSIONS OF THEIR TENANTS!

POMIDA TO FINANCE: REQUEST FOR IMMEDIATE CHANGES TO RENT REDUCTION ARRANGEMENTS!

In view of the fact that we have reached January 21st and real estate landlords are facing a completely unclear situation in relation to what applies in terms of January rent payments and the return process of legal compensations, in a letter to the political leadership of the Ministry of Finance, POMIDA requested immediate changes in the regulations for the reduction of rents, pointing out the most serious problems faced by real estate landlords and proposing immediate measures to solve them. POMIDA TO THE MINISTRY OF FINANCE: RENT REDUCTION: THE DECISION OF THE MINISTRY OF FINANCE SHOULD BE PUBLISHED IMMEDIATELY WITH THE JAN-FEB. 2021! 

The continuous promotion in the media by every competent and incompetent, of the non-payment of rents by businesses that remained closed by state order during the festive period of December 2020 until today, January 15, has as a result, a significant number of tenants of other types of leases, mainly the “afflicted”, independent professionals, crafts, warehouses, etc., but also tenants of houses, declare to their landlords that they do not intend to pay anything at all for January and February 2021!
