POMIDA’S PROPOSALS FOR THE HOUSING BILL IN PARLIAMENT!

Three proposals of POMIDA to increase the supply of housing were presented by the president of the Federation, Mr. Stratos Paradias, during his intervention today in the competent Social Affairs Committee of the Parliament where the s.n. is discussed of the Ministry of Labor and Social Affairs “My house – housing policy for young people”.

Mr. Paradias stated that the bill in the right direction, because it does not adopt rent-based, but substantive measures, but it requested in addition:

  1. Reduction of income tax on principal residence rents by ten units and on three applicable tax brackets, so that taxation is not only fairer, but also an irresistible incentive for housing to be made available for permanent, instead of short-term, rental.

THE TAX LAW 5000/2022 IS PUBLISHED WITH IMPORTANT PROVISIONS FOR PROPERTIES!

Law 5000/2022 entitled“Incorporation into Greek legislation of Directive (EU) 2019/ 2235 – Ratification of an Additional Act to the New Co-Promise between the Hellenic State and the Maritime Community and tax regulations for shipping – Emergency tax and customs regulations – Institutional framework for the operation of the Central State Aid Unit and the State Aid Network – Wage regulations and other financial and development character”,with numerous provisions concerning the taxation of private real estate.

In Part A’ of the law they are incorporated into the Value Added Tax Code and in the National Customs Code provisions aimed at harmonizing the treatment of defense efforts, which are undertaken within the framework of the European Union. with regard to value added tax (VAT) and excise duty (E.F.K.)

POMIDA: THE EXTENSION OF THE 3% CEILING ON COMMERCIAL LEASES IS UNILATERAL AND SOCIALLY UNFAIR!

POMIDA considers the extension of the 3% ceiling on commercial leases for 2023 to be “unilateral and socially unfair”, with a letter to the Prime Minister and the competent Minister of Development Adonis Georgiadis. POMIDA protests because the measure was announced without any previous discussion with the owners, and without any counterweight in their favor, when on the side of the professionals favored by this regulation, a lot of wealthy providers have been received and are being received measures to strengthen them.   

POMIDA believes that instead of prolonging this unfair and dangerous measure, the best direct and effective intervention that the government can and should do of the tenants, it is finally the drastic rationalization of the tax burden on small and medium owners of rented commercial properties and not the continuous taking of unilateral measures against them!

POMIDA: EXPRESS “CONFIDENCE” FOR THE UNCOLLECTED ANCIENTS AND THE RELEVANT LAND REGISTRATION FEES!

Explicit “Disclaimer” for the uncollected old fixed fees of the pilot programs (20-35 euros) and the proportional Land Registry fees (1 o/o up to 900 euros) POMIDA requested in a letter to the staff of the Ministry of Digital Governance responsible for the Land Registry, in consultation with the financial staff of the Government.

In the letter it is emphasized that the property owners are concerned because the procedure for collecting the above fees has recently been updated by law, while there is neither practical, but above all no “political” possibility, by any government, to collect in any way these unfair and effectively time-barred debts , since most of the properties have already gone to new owners who are not related to them.

THE MY HOME HOUSING PROGRAM BILL – THE GUIDE TO THE PROGRAM!

The bill dealing with legal issues for the Social Housing Strategy (My Home Programme) to take effect from the start of 2023 put to a public consultation by the Minister of Labor and Social Affairs, Kostis Hatzidakis. At the same time, it published the Guide with the basic parameters of this program.

For POMIDA, the enormous social value of this program is that it addresses the issue of housing in the right way, which is the renovation of old houses and the production of new ones, and not with the “old-fashioned” politicians’ favorite method of tenancy commitments, which is destructive for the whole society, and first of all , for the new generation of renters, since by definition it would exclude them from any possibility of finding a house to rent… Which means that the recent public letter – intervention of POMIDA to the Prime Minister Mr. Kyriakos Mitsotakis on this topic, entitled “Incentives for the renovation and supply of houses for use as a main residence”!

POMIDA-STOP NOT ON UNILATERAL “STRANGLING” MEASURES OF SHORT-TERM LEASING!!!

A letter to the Prime Minister and the relevant Ministers was sent by the Panhellenic Federation of Property Owners (POMIDA) together with the Association of Short-Term Property Leasing Companies of Greece (STAMA – www.stamagreece.gr), in which they emphasize that the unilateral measures in favor of hoteliers promoted for legislation against short-term rentals lead not to regulation, but in complete economic strangulation of property owners, their managers, employees and their families but also suppliers, businessmen, shopkeepers and the local communities of our country. But also in a huge loss of public revenues, which will require the imposition of additional taxes at the expense of the citizens.

The organizations are asking for a dialogue before it is too late. , for an arrangement that will not unilaterally aim at the interests of hoteliers but at the general interest of the country and its society, so that we all win, and first of all the tourism of our country!

LEGISLATIVE INTERVENTION “STRANGLING” SHORT-TERM LEASES!

Legislative intervention, which will essentially “strangle” the institution of short-term rentals in our country, even though it constitutes 15% of the tourism product of our country, is expected to be carried out immediately by the government.

The direct regulation and demarcation of the market in question, also known as the “sharing economy” and its turnover is now estimated at 3.371 billion euros , is urgently claimed by hoteliers, who, presenting a study prepared on their behalf by the company Grant Thornton entitled “Short-term rentals: impact on cities and citizens”, records both the size of the short-term rental market and “the negative its imprint from the uncontrollable giantization of the activity”. It is also inferred from the data that the tourism expenditure of the sharing economy is growing at an average rate of 15% per year.

According to information, the government presidency in collaboration with both the Ministries of Economy, Environment and Tourism, as well as with the Association of Greek Tourism Enterprises and other representative bodies of tourism, moves in two directions:

MINISTRY OF FINANCE: TAX BILL WITH IMPORTANT PROVISIONS FOR REAL ESTATE IN PUBLIC CONSULTATION!

In public electronic consultation the Minister of Finance, Mr. Christos Staikouras introduced the draft law entitled “Emergency tax regulations – Amendment of the Value Added Tax Code, the Income Tax Code and the Tax Procedure Code – Institutional framework for the operation of the Central Unit of State Aid and the State Aid Network – Other regulations of the Ministry of Finance”, with many important provisions concerning private real estate and its owners, such as the two-year extension of the suspension of capital gains tax and VAT . in real estateand the reduction of income tax for building upgrade costs. Also with article 34 of s.n. the opportunity is given to the Municipalities of the country to submit until 31.12.2022 the opinion of the seventh paragraph of the law on the objective zone values ​​of their territorial jurisdiction, requesting their reduction, especially in areas where they have increased excessively.

LAND LAND: ANNUAL EXTENSION OF THE DEADLINE FOR CORRECTION OF ORIGINAL DOCUMENTS!

Another persistent request of POMIDA was accepted and took the road of its legislation. With an amendment submitted to the Draft Law of the Ministry of Justice “Protection of persons who report violations of Union law – Incorporation of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 (L 305) and other regulations of the Ministry of Justice”, the deadline for correcting the initial registrations in areas that were declared under cadastral registration before the entry into force of Law 3481/2006 is extended for one year.

AT 9.1% THE RATE IN OCTOBER 2022, JUST 0.02 THE IMPACT OF RENTED HOUSES ON THE VAT!

The Timarithm for the month of October decreased further, to 9.1%. While the rhetoric about huge rent increases continues, with the persistent display of individual “provocative” cases, which harms the tenants themselves, ELSTAT finds that the impact of house rents on the Consumer Price Index was only 0.02%! !!The increase in VAT due to the increases in the following groups:

  • *8.6% in the “Hotels- Cafes- Restaurants” group, mainly due to price increases in: restaurants – pastry shops – cafes – canteens, hotels – motels – inns.
  • *4.2% in the “Other goods and services” group, mainly due to an increase in prices in: hairdressers and personal care shops, other items individual care.
