THE INTERPRETATION BY THE MINISTERS OF THE ORDINANCE ON THE UNDECLOSED SQUARES IS WRONG AND OPPRESSIVE FOR THE CITIZENS!

Dear Minister

From the attached documents from 5.4.2022 of the Department of Revenue of the Directorate of Finance of your Ministry, you will see that a very serious problem is being created, due to the blatantly incorrect interpretation of the recent regulation that you proposed to the Parliament for the undeclared square meters (article 18 of Law 4915/24.3.2022).

While with the new provision you extended the deadline for submitting a declaration, replacing “until 31.12.2021 ” with “until 30.6.2022”, covering all those who have made or will make declarations by 30.6.2022, your agency claims that those who submitted declarations before publication of the law (i.e. for the interim period 1.1 to 24.3.2022) and therefore all of them must pay 14 years retroactive municipal fees, plus the heaviest prescribed fines, surcharges, etc.!!!

This interpretation is not only completely wrong, but it is also literally oppressive for the citizens, since it simultaneously violates the elementary rules of good administration, attempting to introduce adverse regulation at the expense of those citizens who hastened previously to the Municipalities to obtain certificates for drawing up legal acts with the old objective values, and creates justified protests for unequal treatment, but also cancellation of contracts, legal disputes, etc.

That is why the Municipality of Athens, which has a long tradition respect for his citizens in this matter, for reasons of good administration, in honor of his leadership and services, applies this provision indiscriminately to all citizens, without unfairly “punishing” those who previously submitted the their statements, before the publication of the above provision.      

In view of the above, I ask you for your immediate intervention to legislate with an interpretative statement or to issue an announcement clarifying the self-evident, that the new regulation covers all declarations of undeclared square meters that will be submitted until 30.6.2022, without unfairly excluding citizens who submitted such declarations in the interval before the publication of Law 4915/24.3.2022.
